Terms & Conditions

MNFST GENERAL TERMS & CONDITIONS

These Terms & Conditions govern the use of the MNFST website and the purchase or use of MNFST’s standalone products and services, including the Marketplace, Sell Assist, Rewards Network, Merchandise and Poster Packs.

By using the website or purchasing any product or service, you agree to these Terms & Conditions.

  1. Definitions

“MNFST”, “we”, “our” or “us” refers to MNFST Pty Ltd.

“You” or “Customer” refers to the individual using our website or purchasing our products or services.

  1. Eligibility

You must be at least 18 years old to purchase products or use seller services offered by MNFST.

  1. Marketplace

MNFST provides an online marketplace connecting buyers and sellers.

MNFST is not the owner of items listed for sale unless explicitly stated.

MNFST does not inspect, verify or guarantee any item listed by third-party sellers.

Buyers are responsible for carrying out their own inspections before purchasing.

All transactions are entered into at the buyer’s and seller’s own risk.

  1. Seller Responsibilities

Sellers must:

  • provide accurate information
  • upload genuine photographs
  • have the legal right to sell the item
  • comply with all applicable Australian laws
  • remove listings that are no longer available where required

MNFST may remove listings that breach these Terms or are considered misleading, unlawful or inappropriate.

  1. Sell Assist

Sell Assist is designed to assist sellers in preparing and promoting their listings.

Sell Assist Levels vary depending on the product purchased.

Sell Assist may include, but is not limited to:

  • professionally written advertisement text
  • listing preparation guides
  • pricing guidance
  • negotiation guidance
  • marketplace listing refreshes
  • featured listings
  • social media promotion
  • personalised listing advice

MNFST provides guidance only.

MNFST does not:

  • communicate directly with buyers
  • negotiate sales on behalf of sellers
  • guarantee a successful sale
  • guarantee any sale price
  • guarantee any timeframe in which an item will sell.

5.1 Sell Assist Levels

  • Current Sell Assist Levels, inclusions, features and benefits are published on the MNFST website and may be updated, amended, added to or removed from time to time at MNFST’s discretion.
  • The Sell Assist Level applicable to a purchase is determined by the qualifying product or order value at the time of purchase.
  • Unless otherwise stated, any changes to Sell Assist Levels will apply to future purchases only and will not alter the benefits already received by customers for previous purchases.

 

  1. Featured Listings

Featured Listings increase the visibility of eligible listings within the MNFST Marketplace.

Visibility and placement are determined by MNFST.

Featured Listing durations commence once activated.

Unused Featured Listing benefits cannot be redeemed for cash or transferred.

  1. Marketplace Listing Refreshes

Listing Refreshes reposition eligible listings within the marketplace.

Refreshes occur in accordance with the Sell Assist Level received.

Unused refreshes expire once the listing expires.

  1. Social Media Promotion

Where included, MNFST may promote listings through its official social media accounts.

The style, wording, images, timing and presentation remain at MNFST’s discretion.

Social media promotion does not guarantee enquiries or a successful sale.

  1. Rewards Network

Rewards Network provides access to discounts, offers and promotions made available by participating businesses.

Offers may change or be withdrawn without notice.

MNFST is not responsible for products or services supplied by participating businesses.

  1. Merchandise

All prices are displayed in Australian Dollars unless otherwise stated.

Delivery times are estimates only.

Colours and sizing may vary slightly.

Faulty items will be handled in accordance with Australian Consumer Law.

  1. Poster Packs

Poster Packs are supplied for personal or business promotional use.

Customers are responsible for ensuring any information submitted for printing is accurate.

MNFST is not responsible for customer spelling, pricing or content errors once approved.

  1. Refunds

Refunds are provided only where required under Australian Consumer Law.

Digital products that have already been delivered or accessed are generally not refundable unless required by law.

  1. Intellectual Property

All MNFST branding, logos, graphics, website content and intellectual property remain the property of MNFST Pty Ltd.

They may not be copied, reproduced or used without written permission.

  1. Limitation of Liability

To the maximum extent permitted by law, MNFST is not liable for:

  • unsuccessful sales
  • pricing decisions
  • buyer or seller disputes
  • marketplace interruptions
  • third-party services
  • loss of profits
  • indirect or consequential loss.

Nothing in these Terms excludes rights that cannot be excluded under Australian Consumer Law.

  1. Privacy

Personal information is handled in accordance with the MNFST Privacy Policy.

  1. Changes

MNFST may amend these Terms & Conditions at any time.

The latest version will always be published on the website.

  1. Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia.

Any disputes will be subject to the jurisdiction of the courts of New South Wales.
